• Late payment fees may apply as specified in your agreement
• Additional costs for changes or add-ons will be documented and approved

5. Cancellation and Refund Policy

Our cancellation policy varies based on timing and circumstances:

• Cancellations more than 180 days before the event: 50% refund of payments made
• Cancellations 90-180 days before the event: 25% refund of payments made
• Cancellations less than 90 days before the event: No refund
• Deposits are non-refundable in all circumstances
• Vendor deposits and non-recoverable costs are client responsibility

We understand that unforeseen circumstances may arise, and we will work with you to find reasonable solutions when possible.

6. Liability and Insurance

Happy Event Co maintains professional liability insurance and encourages clients to obtain appropriate event insurance. Our liability is limited to:

• The total amount paid for our planning services
• Direct damages resulting from our negligence or breach of contract
• We are not liable for vendor performance, venue issues, or force majeure events
• Clients are responsible for guest safety and behavior during events

7. Intellectual Property

All content, designs, plans, and materials created by Happy Event Co remain our intellectual property. Clients receive a license to use these materials for their specific event. We reserve the right to:

• Use photos and descriptions of events for marketing purposes
• Protect our proprietary planning methods and processes
• Prevent unauthorized reproduction of our designs and concepts

8. Force Majeure

Neither party shall be liable for any delay or failure to perform due to circumstances beyond their reasonable control, including but not limited to natural disasters, government regulations, pandemics, labor strikes, or venue closures. In such cases, we will work together to reschedule or modify event plans as appropriate.

9. Privacy and Data Protection

We are committed to protecting your privacy and personal information. Our collection, use, and protection of your data is governed by our Privacy Policy, which forms part of these Terms. We comply with applicable Australian privacy laws and regulations.

10. Modification of Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
